Terms of Service

These Terms of Service form a binding agreement between you and the operator of Get Assistant ("we", "us"). If you accept these terms on behalf of a business, you represent that you are authorized to bind that business, and "you" refers to that business. If you do not agree, do not use the service.

You must be at least 18 years old and able to form a binding contract. The service is intended for business use. You may not use it if you are barred from doing so under applicable law or have previously been suspended for a violation of these terms.

• Provide accurate account information and keep it current.
• Keep your credentials confidential; you are responsible for all activity under your account.
• Control who on your team has dashboard access and remove access promptly when it is no longer needed.
• Notify us promptly if you suspect unauthorized access.

Get Assistant answers inbound phone calls using automated voice AI, follows the business hours, services, FAQs, and call-handling rules you configure, and records the outcome of each call in your dashboard as call logs, caller messages, and appointment requests. Features may change, improve, or be discontinued as the product evolves; we will not materially reduce core functionality of a paid plan without notice.

The service uses automated speech recognition and language models. These systems can mishear names, numbers, and addresses, misclassify intent, produce inaccurate summaries, and occasionally respond in unexpected ways.

You are responsible for reviewing important outcomes and for not relying on the service where an error would cause harm. The service must not be used for emergency calls, medical triage, crisis lines, or any situation requiring immediate human or emergency response.

Calls are delivered through third-party telephony and voice AI providers, and optional features may connect to third-party calendars or other tools. Your use of those services is also subject to their terms. We are not responsible for outages, latency, call quality, number porting issues, or data handling by third parties, and we may change providers.

You may not, and may not permit anyone to:

• Use the service for unlawful, fraudulent, deceptive, harassing, or abusive purposes.
• Use it for unsolicited or automated outbound calling campaigns that violate telemarketing law.
• Impersonate another business or misrepresent who a caller is speaking with in a way that violates law.
• Record or analyze calls without the disclosures and consents your jurisdiction requires.
• Attempt to reverse engineer, resell, or circumvent usage limits, rate limits, or security controls.
• Upload malicious code or interfere with the integrity or performance of the service.
• Use the service for emergency, safety-of-life, or regulated activities it is not designed for.

You retain all rights to the data you and your callers provide, including business configuration, call records, transcripts, recordings, and caller messages. You grant us a limited licence to host, process, transmit, and display that data solely to operate and support the service. Our handling of personal information is described in the Privacy Policy.

You are solely responsible for complying with all laws governing call monitoring, recording, transcription, and disclosure of automated systems, including all-party consent requirements in some jurisdictions. You must configure appropriate greetings and disclosures, and disable recording where you cannot obtain valid consent. You will indemnify us for claims arising from your failure to do so.

Paid plans are billed in advance on a recurring monthly basis at the price shown on our pricing page at the time of purchase. Each plan includes a monthly allowance of AI conversation minutes; usage beyond that allowance is billed at the overage rate configured for your account.

Subscriptions renew automatically until cancelled. Cancelling stops future renewals at the end of the current billing period; unless required by law, fees already paid are non-refundable and partial periods are not prorated. We may change prices with notice effective on your next renewal.

Fees are exclusive of taxes. You are responsible for all sales, use, VAT, GST, and similar taxes, excluding taxes based on our net income. If we are required to collect a tax, it will be added to your invoice.

You may stop using the service and cancel at any time from the billing page. We may suspend or terminate access if you materially breach these terms, if your payment fails, if your use creates legal or security risk, or if required by a provider or by law. Where practical we will give notice and an opportunity to cure. On termination, your right to use the service ends and we may delete your data after a reasonable period; copy anything you need from your dashboard before cancelling.

We and our licensors own the service, including its software, models, interfaces, designs, and branding. Subject to these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to use the service for your internal business purposes. No other rights are granted.

If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free right to use it without restriction or obligation to you.

Each party may receive non-public information from the other. The receiving party will protect it with reasonable care, use it only to perform under these terms, and disclose it only to personnel and providers who need it and are bound by similar obligations, or when legally compelled.

The service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, that every call will be answered, or that AI output will be accurate or complete.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, business opportunities, or data. Our total aggregate liability arising out of or relating to these terms will not exceed the amount you paid us for the service in the twelve months before the event giving rise to the claim. These limits do not apply where the law does not allow them.

You will defend, indemnify, and hold us harmless from claims, damages, liabilities, and reasonable legal costs arising from your use of the service, your content and configuration, your callers' interactions, your breach of these terms, or your failure to comply with recording, disclosure, or telemarketing laws.

These terms are governed by the laws applicable at our principal place of business, without regard to conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. Mandatory consumer protections of your local law remain unaffected. Contact us if you require the specific governing-law jurisdiction in writing before purchasing.

Before filing a claim, contact us and give us 30 days to resolve the dispute informally in good faith. Claims must be brought individually, not as part of a class or representative action, to the extent permitted by law.

We may update these terms as the service evolves. We will update the "Last updated" date and, for material changes, provide notice in the dashboard or by email. Continued use after changes take effect means you accept the updated terms.

These terms, together with the Privacy Policy and any order you place, are the entire agreement between us. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of assets.
